Appealing a Code of Conduct decision is not a review of the case, but rather the process into the decision(s) made. The Code of Conduct appeal process is confidential; however, it may be necessary to contact other individuals in order to complete the review. Procedural Error – A serious error occurred where the procedures in this Code were not followed correctly. The error must be substantial and have impacted the outcome of the complaint. Clerical errors do not qualify.

Conflict of Interest or Bias – Clear evidence that a decision-maker had a significant bias or conflict of interest.

New Evidence – New evidence which was not available at the time of the decision and could change the outcome. Failure to present evidence that was available at the time of the original review does not qualify as new evidence.

Unreasonable Outcome – The decision was unreasonable based on the evidence provided and is supported by facts or the sanction imposed is not consistent with the nature of the offence.
