1. Purpose
To provide guidelines to define the nature of the employment relationship for individuals and/or businesses who provide services to Loyalist College in order to ensure the college is in compliance with CRA regulations.
2. Scope
Any business or individual engaged to provide a service to Loyalist College. For the purposes of this procedure, a business is defined as a sole-proprietorship, partnership, incorporated company, registered charitable organization or registered non-profit community group.
All full-time College employees undertaking part-time assignments for the College will be paid through payroll, whether the agreement is with the employee as an individual or with a registered business with which the full-time College employee is associated.
3. Background
The College wishes to treat employees and businesses in a fair, equitable manner while recognizing it has legal obligations under the Income Tax Act, the Workplace Safety and Insurance Act and College Collective Agreements. Failure to comply with these requirements could result in the College being assessed with penalties and interest, other costs and/or unplanned and non-approved additions to the College’s staff complement. This procedure is designed to clarify the administration of the related regulations.
